Terms of Use

These terms apply when you use alignfitness.com.au, the Align Pilates and Fitness booking app, or purchase or attend our services. By creating an account, making a purchase or booking a class, you agree to these terms and our Privacy Policy.

If you do not agree, please do not use the app. If you are under 18, a parent or guardian must approve your use and participation.

You must provide accurate information, use your own account and keep your password secure. Please tell us promptly if you believe your account has been accessed without permission.

Existing members should register with the same email address already held by the studio so imported credits can be matched correctly.

Prices, inclusions, credit quantities, expiry dates and membership conditions are shown in the store or at checkout. Payments are processed by Stripe. A purchase is confirmed when payment succeeds and the pass or membership appears in your account.

Passes, memberships and credits are personal and may not be transferred, shared, resold or exchanged unless we agree in writing. We may correct an obvious pricing, credit or system error and will contact you if it materially affects your purchase.

Nothing in these terms excludes rights or remedies that cannot be excluded under the Australian Consumer Law.

A booking is confirmed when it appears as confirmed in your account. A class credit is deducted when a booking is made.

To retain your credit, cancel at least 12 hours before the class start time. A cancellation within 12 hours, or failure to attend, may result in the credit being forfeited except where required by law or where we agree otherwise.

If a class is full, you may join its waitlist. Joining a waitlist does not guarantee a place. If a place becomes available, the app or studio may confirm the booking and use the required credit.

We may change an instructor, timetable or location, or cancel a class where reasonably necessary. If we cancel a class, the associated credit will be returned or another appropriate remedy offered.

Pass expiry dates are displayed in your account. Unused credits expire on the stated date unless an extension is required by law or approved by Align Pilates and Fitness. Requests should be made before expiry where possible and are assessed individually.

Pilates and fitness activity involves physical exertion and carries a risk of injury. You are responsible for deciding whether participation is appropriate for you and for seeking medical advice where necessary.

Tell the instructor before class about relevant injuries, pain, pregnancy, medical conditions or movement restrictions. Follow instructor directions, work within your ability and stop immediately if you experience pain, dizziness, shortness of breath or unusual symptoms.

Our services and app content provide general fitness guidance and are not medical diagnosis, treatment or a substitute for professional healthcare.

Members must behave safely and respectfully toward instructors, staff, other members and studio property. We may refuse attendance, suspend an account or cancel a booking where reasonably necessary for safety, serious misconduct, misuse of the app, fraud or repeated breaches of these terms.

We aim to keep the app accurate and available, but maintenance, internet failures, third-party services or technical problems may cause interruptions. If the app is unavailable, contact the studio for help with a time-sensitive booking.

You must not attempt to interfere with the app, access another person’s account or data, introduce harmful code, scrape the service or use it unlawfully.

The app, branding, text, images and other studio materials are owned by or licensed to Align Pilates and Fitness. You may use them only for personal use connected with our services and may not copy or commercially exploit them without permission.

To the extent permitted by law, we are not responsible for indirect or consequential loss arising from use of the app or voluntary participation in services. Any liability that cannot lawfully be excluded is limited only to the extent permitted by law.

These terms do not limit liability for negligence, personal injury or consumer guarantees where the law does not permit that limitation.

Our Privacy Policy explains how we handle personal and health information. It forms part of these terms and is available at alignfitness.com.au/privacy.

We may update these terms when our services, policies or legal obligations change. The current version and effective date will be published here. Changes will not remove rights already accrued under law.

These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable law.
