1. About this policy

Align Pilates and Fitness (“Align”, “we”, “us” or “our”) operates a Pilates studio at 362A Grose Wold Road, Grose Wold NSW 2753 and the website and booking app at alignfitness.com.au.

This policy explains how we collect, hold, use and disclose personal information, including health information. We aim to handle information consistently with the Privacy Act 1988 (Cth), the Australian Privacy Principles and applicable NSW requirements.

2. Information we collect

Depending on how you use our services, we may collect:

  • identity and contact details, such as your name, email address and phone number;
  • account and authentication details;
  • class bookings, cancellations, waitlists, attendance and class history;
  • passes, memberships, credits, purchase records and payment status;
  • health, injury, mobility or accessibility information you choose to provide so we can deliver services safely;
  • communications, enquiries, feedback and complaints; and
  • basic technical information such as device, browser, log and website usage information.

Stripe processes card payments. We do not receive or store your complete card number or card security code.

3. How we collect information

We usually collect information directly from you when you create an account, contact us, purchase a pass, make or cancel a booking, join a waitlist, attend a class, complete a form or tell an instructor about an injury or relevant condition.

We may also receive information from a parent, guardian, authorised representative, payment provider or a service provider used to operate our booking system.

4. Why we use your information

We use personal information to:

  • create and manage accounts, passes, credits and memberships;
  • process payments and provide receipts;
  • manage bookings, attendance, cancellations and waitlists;
  • deliver Pilates and related studio services safely;
  • contact you about your account, bookings, timetable changes or service updates;
  • respond to questions, access or correction requests and complaints;
  • maintain, secure and improve our website, app and studio operations; and
  • meet legal, insurance, accounting and safety obligations.

We will only use health information for direct marketing if you have specifically agreed.

5. Sharing and service providers

We may share information when reasonably necessary with instructors and authorised staff, professional advisers, insurers, regulators or emergency services, and trusted providers that support the app and business.

These providers may include Base44 for app hosting, database and authentication services; Stripe for payments; Google where you choose Google sign-in; and providers of email, analytics, security or technical support.

Some providers may store or process information outside Australia, including in the United States and other countries in which their infrastructure or subprocessors operate. We take reasonable steps to use reputable providers and appropriate safeguards, but overseas laws may differ from Australian law.

We do not sell member information.

6. Health information and consent

Please only provide health or injury information that is relevant to safely participating in our services. By voluntarily providing this information, you consent to us collecting and using it for that purpose. You may withdraw consent, although this may affect our ability to provide a service safely.

Our services are not a substitute for medical advice. In an emergency or where required or authorised by law, information may be disclosed without consent.

7. Security and retention

We use reasonable administrative, technical and physical safeguards and limit access to people who need information for their role. No online system is completely risk-free.

We retain information for as long as reasonably required to provide services, maintain business and legal records, resolve disputes and meet legal, insurance and taxation obligations. When information is no longer required, we take reasonable steps to delete or de-identify it.

8. Access, correction and account requests

You may ask to access or correct personal information we hold about you. You may also ask us to close your account or delete information, subject to any information we must retain by law or for legitimate business records.

9. Cookies and analytics

Our website and service providers may use cookies or similar technology for sign-in, security, preferences, performance and analytics. You can control some cookies through your browser, although disabling essential cookies may prevent parts of the app from working.

10. Complaints

If you have a privacy concern, contact us and explain what happened. We will acknowledge and investigate the concern and aim to respond within a reasonable period.
